These Terms and Conditions ("Terms") apply to your use of the eFoilGlide website at www.efoilglide.com and to purchases made through our online store. Throughout these Terms, "eFoilGlide", "we", "us" and "our" refer to eFoilGlide.
eFoilGlide is based in Toronto, Ontario, Canada and sells SiFly eFoils, components, accessories and related products in Canada.
By using this website or placing an order with us, you agree to these Terms and to the policies that apply to your purchase, including our Refund Policy, Shipping Policy, Warranty Terms and Privacy Policy.
If any provision of these Terms conflicts with rights that you have under applicable consumer protection or other laws that cannot legally be waived, those legal rights will apply.
SECTION 1 - USING OUR WEBSITE
You may use this website to obtain information about our products and services, contact us, and purchase products offered through our online store.
You must not use the website for any unlawful purpose, attempt to gain unauthorized access to the website or related systems, introduce malicious software, interfere with the operation of the website, or use automated methods to access the website in a manner that disrupts or damages it.
You must be at least the age of majority in your province or territory of residence to place an order. If you are under the age of majority, a parent or legal guardian must make the purchase.
SECTION 2 - PRODUCTS AND PRODUCT INFORMATION
We make reasonable efforts to provide accurate product descriptions, specifications, photographs, prices and availability information.
Product photographs are provided for reference. Colours and appearance may vary depending on your display, lighting, manufacturing variations or product updates.
Product specifications may be updated by the manufacturer. Where a material change affects an order that you have already placed, we will contact you before fulfilling the order when reasonably possible.
All products are subject to availability. If a product becomes unavailable after you place an order, we will notify you and provide appropriate options, which may include cancelling the affected item and refunding any amount paid for it.
If we discover a material error in a product description, price or other information affecting your order, we will contact you. You will not be required to accept materially different terms from those presented when you placed your order.
SECTION 3 - PRICES, TAXES AND PAYMENT
Unless otherwise stated, prices displayed on this website are in Canadian dollars (CAD).
Applicable taxes and other charges will be disclosed as part of the purchase process as required.
Available payment methods are those displayed or otherwise communicated to you during the purchase process.
You agree to provide complete and accurate billing, contact and payment information when placing an order.
We may decline or cancel an order where payment cannot be verified, the product is unavailable, we reasonably suspect fraud or unauthorized payment, or we are legally unable to complete the transaction. If we cancel an order after receiving payment, the applicable amount will be refunded.
SECTION 4 - SHIPPING COSTS
Shipping charges may be based on product weight, a fixed shipping rate, or a combination of both. The total shipping charge is shown at checkout before the order is completed.

SECTION 5 - DELIVERY
We currently ship products within Canada only.
Delivery dates and transit times are estimates unless we expressly state that a particular date is guaranteed. Delivery may be affected by carrier delays, weather, remote destinations and circumstances outside our reasonable control.
Nothing in this section limits any cancellation, refund or other rights you may have under applicable consumer protection law when goods are not delivered as required by law.
Please inspect your shipment promptly after delivery and contact us as soon as possible if products are missing, damaged, defective or different from what you ordered.
SECTION 6 - RETURNS AND REFUNDS
Returns and refunds are governed by our Refund Policy.
The Refund Policy explains the applicable return period, eligibility requirements, return authorization process, return shipping responsibility, restocking fees, exclusions and refund processing.
Our Refund Policy does not limit any refund, cancellation or other remedy that you are entitled to receive under applicable law and that cannot legally be excluded or restricted.
SECTION 7 - WARRANTIES, DEFECTS AND SERVICE
Warranty coverage for products sold by eFoilGlide is described in our Warranty Terms.
Manufacturer warranty coverage is separate from any rights or remedies that you may have under applicable consumer protection law.
If you believe that a product is defective or requires warranty service, please contact us before returning or shipping the product so that we can provide the appropriate instructions.
SECTION 8 - SAFE AND LAWFUL USE OF EFOIL PRODUCTS
Electric hydrofoils are powered water-sports equipment and must be used responsibly. Before using an eFoil or related equipment, you should read and follow the manufacturer's manuals, warnings, operating instructions, maintenance instructions and battery safety instructions.
You are responsible for determining whether and where an eFoil may legally be operated and for complying with applicable boating, waterway, safety and other laws and regulations.
Appropriate safety equipment should be used and products should not be operated in a manner contrary to manufacturer instructions or safety warnings.
Nothing in these Terms excludes or limits liability or legal rights where such liability or rights cannot lawfully be excluded or limited.
SECTION 9 - CUSTOMER ACCOUNTS
If you create a customer account, you are responsible for maintaining the confidentiality of your account credentials and for the accuracy of the information associated with your account.
Please notify us if you believe that your account has been accessed or used without authorization.
SECTION 10 - THIRD-PARTY SERVICES
Our online store is hosted on Shopify. We may also use payment processors, shipping providers and other third-party service providers in connection with operating the store and fulfilling orders.
Certain links on our website may lead to websites or services operated by third parties. Those third-party websites and services are governed by their own terms and policies, and we are not responsible for content or services that we do not operate or control.
SECTION 11 - INTELLECTUAL PROPERTY
Unless otherwise indicated, the text, graphics, photographs, layout, branding and other content on this website are owned by or used under authorization by eFoilGlide and may not be copied, reproduced, distributed or commercially exploited without permission, except as permitted by law.
Product names, trademarks, logos and other intellectual property belonging to SiFly or other manufacturers remain the property of their respective owners.

Our collection, use and disclosure of personal information are described in our Privacy Policy.
SECTION 13 - ELECTRONIC COMMUNICATIONS AND ORDER RECORDS
When you place an order or communicate with us electronically, transaction information and communications may also be provided electronically, including order confirmations, invoices, shipping information, warranty communications and notices relating to your purchase.
You should retain your order confirmation, receipt and other transaction records for your records and for any return, warranty or service request.
SECTION 14 - LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, eFoilGlide will not be liable for indirect, incidental, special or consequential losses arising solely from your use of, or inability to access, this website.
This limitation does not exclude or restrict any warranty, remedy, obligation, liability or consumer right that cannot legally be excluded or restricted.
Nothing in these Terms is intended to exclude liability where doing so would be prohibited by applicable law.

You must not use this website for unlawful, fraudulent, abusive or malicious purposes, including attempting to interfere with the operation or security of the website, introducing malicious software, submitting fraudulent orders, or attempting unauthorized access to systems or information.
Where we become aware of suspected fraud, abuse or misuse, we may refuse or cancel an order, decline to provide service, report suspected unlawful activity where appropriate, or take other reasonable steps available to us.
SECTION 16 - CHANGES TO THESE TERMS
We may update these Terms from time to time. The current version and its "Last updated" date will be posted on this page.
Changes to these Terms will apply to future use of the website and future transactions. We will not use a later change to these Terms to materially reduce rights that already apply to a completed purchase unless permitted by law or agreed with you.
